PREAMBLE

These General Terms and Conditions of Sale are entered into exclusively between PEMBREE, a brand of the LOOK Cycle group, operated by LOOK Cycle International, a simplified joint-stock company (société par actions simplifiée) with share capital of €2,515,440, registered in the Nevers Trade and Companies Register under number 419 513 262, whose registered office is located at 27 rue du Docteur Léveillé – 58000 Nevers – France, hereinafter referred to as "PEMBREE," and any person making a purchase on the website pembree.com, hereinafter referred to as "the Customer."

The Customer declares that they are of legal age or hold parental authorization and have the legal capacity to place an order on the Site.

The Parties agree that their relations are governed exclusively by these General Terms and Conditions of Sale, which may be subject to modification. The applicable terms are those in force at the time the order is placed.

1. Purpose

These General Terms and Conditions of Sale (hereinafter the "GTC") apply to any order of PEMBREE premium MTB pedals, accessories, and components offered for sale on the website pembree.com (hereinafter the "Site").

They govern all contractual relations between the Customer and PEMBREE in connection with the online sale of the Products.

2. Orders

It is the Customer's responsibility to select on the Site the Products they wish to order.

The order is placed according to the following steps:

  • creation or use of a customer account (or ordering as a guest);
  • selection of Products and addition to the cart;
  • verification of the cart and the information entered;
  • choice of delivery method;
  • acceptance of the GTC;
  • confirmation of payment.

The order is confirmed by the sending of a confirmation email. This email constitutes acceptance of the order by PEMBREE and forms the contract of sale.

PEMBREE reserves the right to cancel any order in the event of unavailability of a Product, after informing the Customer and refunding the amounts paid.

3. Prices

The prices of the Products are shown in euros, inclusive of all taxes (TTC), for European Union countries, excluding delivery charges.

For countries outside the European Union, prices are shown exclusive of tax. Customs duties and local taxes remain the exclusive responsibility of the Customer.

PEMBREE reserves the right to modify its prices at any time, the Products being invoiced on the basis of the prices in force at the time the order is placed.

4. Shipping Charges

Delivery charges are indicated to the Customer during the ordering process and depend on the country of destination and the delivery method selected.

5. Payment Terms

Payment is due in full at the time of the order.

The accepted means of payment are:

  • bank card (Visa, Mastercard, American Express);
  • PayPal account.

The Customer expressly accepts electronic invoicing.

6. Delivery

6.1 Terms

The Products are delivered to the address indicated by the Customer at the time of the order.

6.2 Timeframes

PEMBREE undertakes to deliver the Products within a maximum period of 30 days from the confirmation of the order, unless otherwise indicated to the Customer.

7. Home Delivery

Delivery is deemed to have been made upon handover of the parcel to the Customer or to a third party designated by them.

In the event of an incorrect or incomplete address, PEMBREE cannot be held liable for the impossibility of delivery.

8. Right of Withdrawal

In accordance with the regulations in force, the Customer has a period of 14 days from receipt of the Product to exercise their right of withdrawal without having to justify a reason.

The Products must be returned:

  • unused;
  • complete;
  • in their original packaging.

Return costs are borne by the Customer.

9. Return Procedure

Any return request must be made through the customer account, under the "My Orders" section.

After validation by PEMBREE, the Customer will receive return instructions.

10. Legal Guarantees

PEMBREE Products benefit from:

  • the legal guarantee of conformity (Articles L217-1 et seq. of the French Consumer Code);
  • the guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code).

11. Liability

PEMBREE cannot be held liable in the event of misuse of the Products, normal wear and tear, or failure to comply with the instructions provided.

In the event of a dispute, the Customer may make free use of a consumer mediator in accordance with Articles L612-1 et seq. of the French Consumer Code.

13. Intellectual Property

All elements of the Site are the exclusive property of PEMBREE or the LOOK Cycle group. Any reproduction is prohibited without prior authorization.

14. Applicable Law

These GTC are subject to French law. Any dispute shall fall under the jurisdiction of the competent French courts.
